Retail customer eligibility

Aqua Tanks online promotions are available only to retail customers purchasing eligible products directly from Aqua Tanks through aquatanks.co.nz at the advertised promotional retail price, unless expressly stated otherwise.

Promotions do not apply to purchases made by or through dealers, resellers, distributors, wholesale customers, trade account customers or other third parties.

Dealer pricing, wholesale pricing, trade discounts, contract pricing, project pricing, negotiated pricing and other discounted arrangements are excluded from online retail promotions.

Any promotion available specifically to Aqua Tanks dealers will be communicated separately and will include its own eligibility requirements, products, promotional period and conditions.

Specific promotion terms

These general Promotion Terms and Conditions apply together with the eligibility requirements, products, dates, quantities, prices and other conditions displayed on the relevant promotional product or campaign page.

If there is any inconsistency between these general terms and the specific terms displayed on a promotional page, the specific promotional terms will apply to that promotion, provided they were clearly disclosed to the customer before purchase.

Promotion period and availability

Each promotion is valid only for the period stated on the relevant promotional page or while the stated promotional stock remains available.

Where no closing date is stated, Aqua Tanks may end or amend the promotion by updating the relevant promotional page. Any amendment, suspension or withdrawal will apply only to orders placed after the change is published and will not affect qualifying orders already accepted by Aqua Tanks.

Any product limits, customer limits, geographic restrictions, delivery restrictions or stock limitations will be stated on the relevant promotional page.

All promotions and promotional products are subject to availability.

Combining promotions

Promotional offers cannot be combined with dealer pricing, trade discounts, wholesale pricing, multi-buy discounts, discount codes, contract pricing, project pricing, negotiated pricing, account pricing or any other promotional offer unless expressly stated otherwise.

Only one promotional benefit may be claimed for each eligible product unless the relevant promotional page expressly permits offers to be combined.

Promotional pricing and advertised savings

All consumer prices are in New Zealand dollars and include GST unless expressly stated otherwise.

Promotional prices and discounts apply only to the specific products, tank sizes, variants, combinations and quantities identified on the relevant promotional page.

Any advertised saving, product value or comparison price will be based on the genuine standard individual selling price of the relevant products at the time the promotion is published.

Where a promotion includes a complimentary product, the advertised value of that product refers to its standard individual retail price. A value comparison does not represent a previous selling price for the promotional bundle unless the bundle was genuinely offered for sale at that price.

Delivery charges, ferry crossing charges, installation costs and other additional charges are excluded unless expressly stated otherwise. Any applicable charges will be disclosed before the customer completes the purchase.

Promotional discounts cannot be exchanged for cash or account credit.

Qualifying online orders

The promotional price or benefit will apply only when all eligibility requirements are met, and the qualifying products are purchased in the same online transaction.

The customer must ensure that all qualifying products, accessories, variants and quantities have been added to the cart before completing the purchase.

Where a discount is applied automatically at checkout, the discount will apply only when the required quantity of eligible products is present in the cart.

Promotions cannot be applied retrospectively to previous purchases, quotes, confirmed orders, invoices, dispatched orders or completed transactions.

Product bundles

A promotional bundle consists only of the tanks, products and accessories expressly listed on the relevant promotional product page and order confirmation.

To qualify for the advertised bundle price or promotional benefit:

• All products included in the bundle must be purchased together in the same online transaction.
• Bundle products cannot be separated or exchanged for another product, cash or account credit unless Aqua Tanks agrees otherwise.
• Bundle components cannot be purchased individually at a proportional bundle price.
• Bundle colours, models and accessories are subject to the options displayed on the relevant promotional page and to stock availability.
• Promotional images may be illustrative. Only the products expressly identified in the product description and order confirmation are included.

Complimentary products and accessories

Where a promotion includes a complimentary product or accessory:

• One promotional accessory will be supplied per eligible tank purchased unless the relevant promotion states otherwise.
• The complimentary item must be selected or included when the qualifying order is placed.
• The complimentary item cannot be claimed separately or retrospectively unless Aqua Tanks agrees otherwise.
• There is no cash or account credit alternative.
• Only the quantity expressly stated in the promotion will be supplied.
• The complimentary item cannot be combined with another promotion for the same qualifying product unless expressly stated otherwise.
• The complimentary item remains subject to all rights and guarantees that apply under New Zealand consumer law.

Colours, models and promotional products are subject to availability.

If the selected complimentary product, accessory, model or colour is unavailable, Aqua Tanks will contact the customer and may, with the customer’s agreement:

• provide a comparable alternative;
• allow the customer to wait for the selected item to become available;
• proceed without the promotional item on terms agreed with the customer; or
• cancel the affected order and provide a full refund of any amount paid.

Aqua Tanks will not substitute a materially different product, model or colour without the customer’s agreement.

Buy More, Save More promotions

The Buy More, Save More bulk discount applies only to selected eligible Aqua Tanks purchased in the same online transaction.

The applicable discount will be automatically applied at checkout once the qualifying quantity of eligible tanks has been added to the cart.

Unless expressly stated otherwise:

• Only tanks identified as eligible on the relevant promotional page will count towards the qualifying quantity.
• Eligible tank sizes may be mixed and matched only where stated on the relevant promotional page.
• The discount applies only to eligible tanks.
• Delivery charges, accessories, installation services and other non-eligible products do not count towards the qualifying quantity and are excluded from the discount.
• The promotion cannot be exchanged for cash or account credit.
• The promotion cannot be combined with another discount, promotional offer, coupon code, dealer pricing, trade pricing, negotiated pricing or account pricing.
• The promotion is subject to product and stock availability.

Voluntary bundle cancellations and returns

Where Aqua Tanks permits a voluntary change-of-mind cancellation or return, all products and complimentary items included in the promotional bundle must be returned unused and in their original condition.

If the customer voluntarily retains part of a bundle, Aqua Tanks may recalculate the price of the retained products using their standard individual selling prices and deduct the recalculated amount from any discretionary refund.

If a customer voluntarily cancels or returns one or more tanks purchased under a Buy More, Save More promotion and the remaining quantity no longer qualifies for the original discount, Aqua Tanks may recalculate any discretionary refund using the discount applicable to the revised quantity.

These recalculation provisions apply only to voluntary, or change-of-mind returns accepted by Aqua Tanks. They do not apply where the customer is exercising a right or remedy under the Consumer Guarantees Act 1993, the Fair-Trading Act 1986 or any other applicable law.

Faulty, damaged or incorrectly supplied products

Nothing in these promotional terms limits a customer’s rights where a product or complimentary item is faulty, unsafe, damaged, not fit for purpose, does not correspond with its description or otherwise fails to comply with New Zealand consumer law.

Aqua Tanks will provide any repair, replacement, refund, compensation or other remedy required under the Consumer Guarantees Act 1993, the Fair-Trading Act 1986 or any other applicable law.

Genuine pricing or website errors

Aqua Tanks may correct a genuine and obvious pricing, calculation, technical or product-description error before accepting an order.

If an error is identified before the order is accepted, Aqua Tanks will contact the customer and offer the customer the choice of:

• proceeding with the order at the corrected price or on the corrected terms; or
• cancelling the affected order and receiving a full refund of any amount already paid.

Aqua Tanks will not alter the price or material terms of an accepted order without the customer’s agreement, except where permitted by law.

Changes to promotions

Aqua Tanks may amend, extend, suspend or withdraw a promotion where reasonably necessary, including because of stock availability, supplier changes, technical errors or circumstances outside Aqua Tanks’ reasonable control.

Any amendment, suspension or withdrawal will apply prospectively and will not affect a qualifying promotional order already accepted by Aqua Tanks.

Delivery and product exclusions

Delivery charges, delivery areas, ferry crossing charges, site-access requirements and product exclusions may apply as stated on the relevant promotional product page and in Aqua Tanks’ standard delivery terms.

Promotional discounts do not apply to freight, delivery, unloading, installation or other services unless expressly stated otherwise.

Standard terms and conditions

Aqua Tanks’ standard online sales terms, payment terms, delivery requirements, installation requirements, warranty conditions and privacy terms continue to apply.

Where there is an inconsistency, the specific terms of the relevant promotion will apply only in relation to that promotional offer.

Consumer rights

Nothing in these Promotion Terms and Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Consumer Guarantees Act 1993, the Fair-Trading Act 1986 or any other applicable New Zealand law.
